Jumpflex Terms and Conditions

Contents

1. Overview & Agreement to Terms

Welcome to www.jumpflex.com.au. By accessing or using this website (the 'Website'), or purchasing from Jumpflex Australia Pty Limited (ARBN 611 941 934) ('Jumpflex', 'we', 'us' or 'our'), you agree to be bound by these Terms and Conditions (the 'Terms') and all other terms, conditions, policies and notices stated here and on our Website, including our Privacy Policy, Shipping Policy and Return and Refund Policy, each of which is incorporated into these Terms by reference. These Terms govern your access to and use of the Website and the purchase of any Jumpflex products. If you do not agree, please do not use the Website or proceed with a purchase.

Certain legislation, including the Australian Consumer Law, provides consumer guarantees and other rights that cannot be excluded, restricted or modified. These Terms are subject to that legislation, and nothing in them limits those rights.

The Terms that apply to your purchase are those in force when you place your order, including the versions of our Shipping Policy and Return and Refund Policy at that time. The warranty that applies to a product is the one in force when you bought it. A later order for parts or accessories does not change or extend that warranty. The safety guidelines, responsibilities and liability terms in the version in force at your most recent order apply to your use of all Jumpflex products you own, and by placing an order you confirm that you have read them. If the law requires a change, it applies as the law requires. We may update the terms governing your use of the Website by posting a new version, and the current version is always available on this page.

Our products are meant to be enjoyed by families and children, but the use of our Website and the purchase of products through it are not intended for children. By agreeing to these Terms, you confirm that you are at least 18 years of age.

If you are making a purchase on behalf of another person, you confirm that you are authorised to do so and that you are acting as their agent. If you are entering into these Terms on behalf of a company or other legal entity, you confirm that you have authority to bind it, and 'you' includes that entity. If you do not have that authority, please do not place the order. Any new features, products or services added to the Website will also be subject to these Terms.

2. Business Customers

These Terms are written mainly for consumers buying for personal, domestic or household use. If you are buying in the course of a business, or for hire or commercial use, you are a 'Business Customer'. Where the Australian Consumer Law applies to your purchase, its consumer guarantees continue to apply and nothing in these Terms limits them. In addition:

  • our 30-day change-of-mind return does not apply, and returns are accepted only with our prior written agreement;
  • the products are supplied with our standard manufacturer's warranty (section 8) only, and are designed for domestic use, so commercial or non-domestic use voids the warranty (section 8.2);
  • to the extent the Australian Consumer Law allows, where goods are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to comply with a consumer guarantee is limited to replacing or repairing the goods, or paying the cost of replacing or repairing them; and
  • purchase for resale is not permitted.

Where we identify that an order has been placed for resale or commercial use, we may, before dispatch, cancel the order and issue a full refund.

3. Conditions of Sale; Order Acceptance; Pre-Orders

All prices are listed in AUD and are inclusive of GST unless stated otherwise. Applicable shipping or additional charges are shown at checkout. By placing an order, you confirm that you are authorised to make the purchase and that you accept these Terms in full.

Order acceptance. Your order is an offer to buy. Receipt of an order confirmation does not signify our acceptance of your order. A contract is formed only when we dispatch the products to you. We may require additional verification or information before accepting an order.

Declining or cancelling an order. We may decline or cancel an order before dispatch, for example if the product is out of stock, if there has been a pricing or product information error, or if we suspect fraud. If we decline or cancel your order, we will refund any amount you have paid in full.

Cancelling your order. You can ask to cancel your order. Please contact us as soon as possible. How we handle it depends on how far your order has progressed, as set out in our Return and Refund Policy.

Pre-orders. Our Shipping Policy sets out how pre-orders work, including estimated shipping dates, cancelling before an item ships, and how accessories ship with a pre-order trampoline.

Product descriptions. If the goods you receive do not match the description on our Website, please tell us as soon as possible so we can take appropriate action.

Title. Ownership of the products passes to you only when you have paid for them in full and they have been delivered. Risk passes to you on delivery, as set out in our Shipping Policy.

Our Shipping Policy and Return and Refund Policy are available on our Website.

4. Pricing, Payment & Currency

Payment must be made in full at the time of purchase. Prices are subject to change without notice, but the price that applies to your order is the price shown at checkout when you place it. If a product is listed at an incorrect price, or with incorrect information due to an error in pricing or product information, we may cancel the order and issue a full refund if you have already been charged. Except as set out in these Terms, your statutory rights and our Return and Refund Policy, fees are non-refundable.

Payments and third-party processors. We are the seller of the products, and your contract for the goods is with us. Payments are processed by third-party payment providers (such as Shopify Payments and associated payment processors), and your use of those services may be subject to their own terms and privacy policies. Your rights and remedies in respect of the products remain against us.

Promotions. We may from time to time offer promotions, which are subject to change at any time due to stock availability. Promotions on the Website or in print do not constitute a binding agreement. Only a promotion valid at the point of purchase is binding.

Insurance claims. Pricing for insurance claims is based on the full Recommended Retail Price (RRP).

5. Shipping, Delivery & Risk

Delivery, Authority to Leave, damage in transit, risk, rural deliveries and failed deliveries are covered by our Shipping Policy, which forms part of these Terms. Please read it before you order. Delivery times quoted on the Website are given in good faith but are estimates only, and we are not bound by them.

6. Assumption of Risk and Responsibility

Risk warning. USING TRAMPOLINES OR OUTDOOR PLAY EQUIPMENT INVOLVES A SIGNIFICANT RISK OF INJURY, INCLUDING SERIOUS INJURY, PERMANENT DISABILITY OR DEATH. To the extent permitted by law, all participants use the product at their own risk. By purchasing and using any Jumpflex product, you acknowledge these inherent risks and confirm that you have read and understood the safety instructions provided.

Jumpflex products are designed strictly for residential, outdoor, domestic use. You are responsible for using and maintaining the product safely, including:

  • assembling the product strictly in accordance with our instruction manual (adult assembly is required);
  • checking on delivery that all components are included and appear to be in good condition with no visible faults before assembly;
  • carrying out regular inspection and maintenance;
  • following all safety guidelines and warnings at all times;
  • not exceeding the stated weight or user limits;
  • not modifying the product or fitting unauthorised or third-party parts;
  • not using the product in unsuitable weather or environmental conditions; and
  • being responsible for all users of the product, including making sure they follow these Terms and the safety guidelines.

Our products are susceptible to environmental conditions and bad weather, and can move or lift in strong winds. Ensure the trampoline is sufficiently stable; anchor kits may be suitable anchorage devices. Anchor kits are aids to help secure the trampoline to the ground. They are not a guaranteed preventative against movement or damage arising from environmental factors, and we do not accept responsibility for damage to the trampoline or to property caused by the anchor kit system. If your product will be unused for an extended period, disassemble it and store it in a dry place. See your product manual for further information.

Injuries and deaths can be caused by many things, including:

  • colliding with another person on the trampoline;
  • landing improperly while jumping or doing stunts on the trampoline;
  • falling or jumping off the trampoline;
  • falling on the trampoline springs or frame; and
  • other causes, including misuse, incorrect assembly, weather or environmental conditions, equipment wear or failure, and use that does not follow these guidelines or the product manual.

Safety guidelines. To reduce the risk of serious injury, you should be aware of and abide by standard safety guidelines at all times, including:

  • Allow only one person on the trampoline at a time.
  • Do not attempt or allow somersaults, as landing on the head or neck can cause paralysis.
  • Do not use the trampoline without shock-absorbing pads that completely cover its springs, hooks and frame.
  • Place the trampoline away from structures, trees and other play areas.
  • No child under 6 years of age should use a full-size outdoor trampoline, including our Flex, Hero and MEGA ranges.
  • Always supervise children who use a trampoline.
  • Use the trampoline only under the supervision of a responsible adult who is familiar with the safety guidelines and instructions for proper use.
  • Instruct children not to use the equipment in a manner other than intended.
  • Ensure the trampoline enclosure is used, securely in place, fully closed during use and properly maintained.
  • Inspect before use and keep frame padding in place.
  • Climb on and off the trampoline. Do not use it as a springboard.
  • The trampoline ladder must be removed and stored in a secure location whenever the trampoline is not in use. The ladder should only be attached when a responsible adult is present to supervise jumping. Never leave the ladder attached while the trampoline is unattended, because it provides unsupervised access by small children.
  • Stop the bounce by flexing your knees as your feet come in contact with the bed.
  • Learn fundamental bounces and body positions thoroughly.
  • Avoid bouncing too high and maintain control.
  • Keep your eyes focused on the trampoline toward the perimeter.
  • Bounce in the centre of the mat.
  • Avoid bouncing when tired.
  • Secure the trampoline against unauthorised use.
  • Keep objects away which could interfere with the performer.
  • Do not use the trampoline while under the influence of alcohol or drugs.
  • Do not use when the trampoline is wet or in windy conditions.
  • Read all instructions and manuals before use.

Local rules and approvals. Installing a Jumpflex product may be subject to local planning rules, building regulations and council requirements, including rules about height, boundaries and neighbouring properties. You are responsible for making sure the location, height and use of the product comply with all applicable rules and for obtaining any approvals you need. To the extent permitted by law, we are not liable for any enforcement action, fines or requirement to remove the product that results from a failure to do so.

Our responsibility. To the extent permitted by law, Jumpflex and its employees, directors and agents are not responsible for injury, loss or damage caused by: failure to follow our instructions or to assemble the product in accordance with our manual; misuse or use other than as intended; inadequate inspection or maintenance; unauthorised modification; normal wear and tear; exposure to weather or environmental conditions; or recklessness or negligence by the buyer or any user.

This section does not limit our liability for injury caused by our negligence where the law allows a claim. See section 14 for more on your statutory rights and our liability.

7. Indemnity

You agree to indemnify and hold us harmless from losses, costs and claims we suffer arising from: (a) your unlawful use of the Website; (b) your infringement of any third party's intellectual property or other rights; (c) your fraud or fraudulent misrepresentation; or (d) your use of the product for commercial or non-domestic purposes in breach of these Terms. This indemnity applies only if you act unlawfully, commit fraud, infringe intellectual property, or use the product in breach of its intended purpose, and does not apply to losses caused by our breach, negligence or failure to comply with the law.

8. Warranty

The warranty in this section is given by Jumpflex Australia Pty Limited (ARBN 611 941 934) (contact details are in section 18). It is provided in addition to, and does not limit, your rights under the Australian Consumer Law (see section 14).

8.1 Warranty coverage. This warranty covers manufacturing faults and defects only. Warranty periods begin from the date the product is shipped to you. Replacing a part does not reset or extend the original warranty period. Spare parts and accessories bought separately carry their own 1-year warranty, from the date they are shipped to you. This warranty is provided to the original purchaser only and is not transferable.

If you believe a Jumpflex product is faulty or defective, you must stop using it and contact us. Any damage you cause as a result of continuing to use a faulty or defective product may void the warranty for that issue. Any replacement part under warranty may be a replacement of the original part or a new part for the same function.

Hero & Mega Series

  • 10 years – frame
  • 5 years – jump mat
  • 5 years – springs
  • 1 year – spring pad
  • 1 year – net poles
  • 1 year – safety net
  • 1 year – accessories

Flex Series

  • 5 years – frame
  • 1 year – jump mat
  • 1 year – springs
  • 1 year – spring pad
  • 1 year – net poles
  • 1 year – safety net
  • 1 year – accessories

Component notes. The frame warranty covers only the metal frame, against abnormalities, and does not cover weather damage, external damage or damage due to overloading. The jump mat warranty does not cover damage due to misuse or normal wear and tear. The spring pad and safety net warranties do not cover faults caused by lack of maintenance, weather damage, misuse, incorrect assembly or normal wear and tear.

Lifetime Warranty (if purchased). The optional Jumpflex Lifetime Warranty covers any fault, defect or failure that occurs as a result of the manufacturing process. It excludes damage due to misuse, poor maintenance, incorrect installation, acts of nature or normal wear and tear; external sources such as fire, theft, cuts or vandalism; cosmetic imperfections that do not affect function; trampoline accessories (unless specified otherwise); and use in a commercial setting. It is not transferable.

8.2 Warranty exclusions. The warranty does not cover:

  • Wear and tear: surface rust smaller than 2 cm, holes or tears in the jump mat smaller than 2 cm, fading, stretching or deterioration of materials over time, and UV damage or fabric disintegration due to sun exposure.
  • Weather and environmental conditions: damage caused by wind, storms, snow or sun exposure; snow load, ice build-up or extreme temperatures affecting product lifespan; and exposure to ocean spray or assembly within 1.6 km of a saltwater environment, in which case warranty on steel parts may be reduced by 50%.
  • Improper installation: any issues resulting from incorrect assembly or not following the official Jumpflex assembly manual, or damage or failure due to missing components not reported before installation.
  • Installation: we do not sell installation services. If we give you a link or contact details for a third-party installer, that installer is independent of Jumpflex and we are not responsible for their work. The warranty does not cover faults caused by incorrect assembly, whoever carries it out, and does not cover installation costs.
  • Insufficient maintenance: premature wear due to lack of regular inspection, cleaning or following care instructions, and damage from mould, rust or build-up due to improper storage or use.
  • Misuse: using the trampoline for gymnastic, stunt or commercial purposes, attaching third-party accessories or making unauthorised modifications, or exceeding the maximum user weight or allowing multiple users in ways not outlined in the safety guidelines.
  • High-intensity or continuous use: the warranty does not cover premature wear and tear or damage (such as snapped springs, torn mats or bent frames) caused by high-intensity, continuous or prolonged repetitive jumping that goes beyond normal backyard family play.
  • Commercial use: Jumpflex products are designed for residential use only. Use in schools, gyms, parks, play centres, or hired or rented out to others voids the warranty.
  • Personal injury or incidental loss: this warranty does not cover personal injuries or losses resulting from product misuse, improper assembly, failure to follow safety and maintenance guidelines, or negligence or accidents.

Note on weight limits: the maximum user weight limit tells you how much weight the trampoline can safely hold during normal backyard play. It does not guarantee the lifespan of the parts (such as the springs and mat) if the trampoline is subjected to continuous, high-intensity jumping, even if the user is well below the weight limit.

None of these exclusions limits your rights under the Australian Consumer Law.

8.3 Making a warranty claim. Contact our Customer Service team at hello@jumpflex.com.au or call 1800 586 735. Please clearly state the problem and include your order number, the date of purchase, a description of the item, your best daytime contact number and, where possible, photos of the fault. We will assess your claim and work with you to find the best solution, which may be replacement parts, a repair or a replacement. Replacement parts may be new or refurbished. We will bear the reasonable cost of returning goods to us where we ask for them back, and the cost of delivering replacement parts to your address in Australia. If your goods are outside the warranty period, we may still be able to repair them. In that case the cost of the repair, including freight, may be charged to you, but this does not limit your rights under the Australian Consumer Law, which continue regardless of the warranty period.

9. Order Cancellation & Returns

Cancelling an order, change-of-mind returns, faulty or damaged goods, deductions and refunds are covered by our Return and Refund Policy, which forms part of these Terms. Please read it before you order. Our warranty is covered in section 8.

10. Privacy Policy

We respect your privacy and comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Please see our Privacy Policy for details of how we collect, use and disclose your personal information.

11. Intellectual Property; Acceptable Use

Jumpflex reserves all rights, title and interest in and to the Website and our products, including all copyright, trademarks and other intellectual property. Materials on the Website may not be modified, reproduced, publicly displayed, performed, distributed, or used for any public or commercial purpose without our written permission. Any feedback or submissions you give us regarding the Website or products may be used by us without obligation to you. You may not post or transmit material that is unlawful, infringing, defamatory or harmful, or interfere with the operation or security of the Website. We may modify, suspend or terminate operation of or access to the Website at any time.

Copyright policy. We do not permit copyright-infringing activities on the Website. If you believe content on the Website infringes your copyright under the Copyright Act 1968 (Cth) (or other applicable Australian law), you may notify us by providing: your signature (electronic or physical) or that of a person authorised to act for you; a description of the material you claim is infringing and where it is located on the Website; your address, telephone number and email address; a statement that you believe in good faith that the use is not authorised; and a statement that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf. Contact us at hello@jumpflex.com.au.

12. Third-Party Links

Our Website may link to external websites operated by third parties. We have no control over, and are not responsible for, the content or practices of those sites. Links are provided for your convenience and do not constitute an endorsement unless expressly stated.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you can bring legal proceedings in the courts of New South Wales. Nothing in these Terms removes any mandatory legal protection available to you under Australian law.

14. Your Statutory Rights, Disclaimers and Limitation of Liability

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

14.1 Your statutory rights. Your rights under the Australian Consumer Law include the guarantees set out in the statement above. Our warranty is provided in addition to, and does not limit, your statutory rights. For more information about your rights, visit the ACCC website at accc.gov.au.

14.2 Website disclaimers. We use commercially reasonable efforts to display accurate colours and images of our products, but we cannot guarantee that your screen will display any colour accurately. Occasionally the Website may contain typographical errors, inaccuracies or omissions, and we may correct them and change or update information, or cancel orders, where information is inaccurate. The Website is provided on an 'as available' basis, and we are not responsible for delays or failures resulting from problems inherent in the use of the internet.

14.3 Warranty disclaimers. Except for the warranty described in section 8, our Return and Refund Policy, and your statutory rights, all other conditions, representations and warranties regarding our Website and products are disclaimed to the maximum extent permitted by law.

14.4 Limitation of liability. Nothing in these Terms limits or excludes our liability for: (a) fraud or misleading or deceptive conduct; (b) any failure to comply with a consumer guarantee under the Australian Consumer Law, except to the extent the Australian Consumer Law allows that liability to be limited; or (c) any other liability that cannot be limited or excluded by law.

Subject to the above, to the extent permitted by law our total liability to you arising out of or in connection with your purchase, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the price you paid for the product giving rise to the claim. We are not liable for any indirect, special or consequential loss, including loss of use, loss of data, loss of business or profits.

15. Dispute Resolution

We want to resolve any issue quickly and fairly. If you have a complaint or dispute regarding our Website, our products or these Terms, please first contact us at hello@jumpflex.com.au so we can try to resolve the matter informally. If we cannot resolve it, you may be able to contact your State or Territory consumer protection agency, or you may bring proceedings in accordance with section 13.

16. Suspension; Termination

We may suspend or terminate your access to the Website if we determine that you have violated these Terms. You remain responsible for any fees, costs or expenses incurred before termination. Provisions concerning proprietary rights, disclaimers, limitation of liability, indemnity and governing law survive termination.

17. Miscellaneous

  • Users outside Australia. The Website is operated for Australia. If you access it from outside Australia, you do so on your own initiative and are responsible for complying with applicable local laws.
  • Electronic communications. When you use the Website or email us, you consent to receive communications from us electronically.
  • Severability. If any provision of these Terms is held invalid or unenforceable, it will be construed to reflect its intention as far as possible, with the other provisions remaining in full effect.
  • Entire agreement. These Terms, together with our Privacy Policy, Shipping Policy and Return and Refund Policy, are the entire agreement between you and Jumpflex regarding your use of the Website and our products.
  • Waiver. Our failure to insist on strict performance of these Terms is not a waiver.
  • Third parties. These Terms do not confer any rights or remedies on third parties.
  • Assignment. We may transfer our rights and obligations under these Terms to another organisation, provided this does not affect the supply of products you have ordered. If it would, we will tell you and you may cancel and receive a full refund of any amount paid for products not yet delivered. You may not transfer your rights or obligations under these Terms without our written consent.
  • Force majeure. Our failure to perform any term as a result of conditions beyond our control (for example natural disasters, war, strikes or pandemics) is not a breach of these Terms.
